Talen Energy threatens to sue FERC for rejecting nuclear-powered data center

Talen Energy is threatening to sue the Federal Energy Regulatory Commission over its order blocking the expansion of an Amazon data center at Talen’s Pennsylvania nuclear plant.

FERC’s November order rattled the nuclear industry, prompting a drop in stock prices and stirring debate about whether similar deals could be in jeopardy. Amazon, Google and other technology giants are eager to co-locate power-hungry data centers at power plants and have urged FERC to clarify co-location rules.

In the 2-1 vote in November, FERC denied the Amazon expansion at the Susquehanna Nuclear facility on a technicality. The two Republican commissioners opposed Talen’s plan, while Chair Willie Phillips dissented and the other two Democratic commissioners abstained from the vote.

Talen requested a rehearing — a plea for FERC to reconsider its order — and FERC said in December that it would address the request in a future decision. But the company said the Commission has taken too long to respond.
