States, business groups challenge Biden-era water heater rule

The Department of Energy estimated the rule will reduce emissions by 32 million metric tons of carbon dioxide over a 30-year period.

A coalition of 21 state attorneys general and business groups challenged the Energy Department’s recent rulemaking setting energy efficiency standards for gas-fired instantaneous water heaters.

The coalition behind the petition for review filed Friday in the 11th U.S. Circuit Court of Appeals includes the attorneys general of Alabama, Arkansas, Georgia, Idaho, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Utah, Virginia and West Virginia.

The petition was also supported by the National Propane Gas Association, the National Association of Home Builders, the American Gas Association, the American Public Gas Association and Rinnai America, among others.

DOE did not immediately respond to a request for comment on the filing Friday.
