Red states target EPA methane fee

The lawsuit comes as the fee, which is set to go into effect Friday, faces potential reversal by congressional Republicans.

A 23-state coalition is suing to block EPA’s new methane fee, days before President-elect Donald Trump is set to return to the White House.

The fee — created by Congress under the Inflation Reduction Act — targets the oil and gas sector’s emissions of the potent greenhouse gas. Texas Attorney General Ken Paxton, who is leading the legal challenge, said EPA’s rule to implement the fee is not only bad policy but unlawful.

“Over the past four years I have opposed the Biden Administration more than 100 times to stop its radical attempts to undermine the law. I am positive this last-minute effort to harm the energy industry will be halted as well,” the Republican said in a statement announcing the lawsuit Thursday.

“In only four days, when President-elect Trump resumes office, America will no longer be burdened by a runaway bureaucracy intent on destroying our liberties,” he added.
