6th Circuit wins lottery to hear climate cases

Lawsuits over a federal fuel economy rule have been consolidated at the conservative-leaning court.

Lawsuits challenging a new Biden administration fuel economy rule will be heard in a conservative-leaning federal appeals court in Ohio.

The Judicial Panel on Multidistrict Litigation on Friday announced that eight challenges to the National Highway Traffic Safety Administration rule for passenger cars and light-duty trucks will be consolidated at the 6th U.S. Circuit Court of Appeals in Cincinnati.

Twenty-six Republican-led states, as well as the American Petroleum Institute and other industry groups had filed lawsuits challenging NHTSA’s rule in federal appeals courts with more conservative judges. Environmental groups that wanted NHTSA’s rule to be more restrictive had filed their lawsuits in more liberal-leaning courts.

Conservatives and industry groups have accused the Biden administration of looking to drive gas-powered vehicles off the road with the new NHTSA regulation.
